Anjan Singha v. The State of Assam

ORDER 06-12-2024 Heard Mr. G. Bargayari, learned counsel for the petitioner and Mr. K. K. Parasar, learned Additional Public Prosecutor, Assam for the State.

¶2Apprehending his arrest, the petitioner, namely, Anjan Singha, son of Bibharani Singha, resident of M. K. Road, Thalipukhuri, P.S.-Halem, District-Biswanath has filed this application under Section 438 CrPC seeking pre-arrest bail in Halem P.S. Case No. 38/2024 registered under Sections 379/420/34 IPC read with Section 53(1) (a) of the Page No.# 2/2 Assam Excise Act, 2000 corresponding to G.R. No. 115/2024.

¶3During the deliberation of the matter, Mr. K. K. Parasar, learned Additional Public Prosecutor, Assam on instruction, submitted that police after completion of investigation of the case has already submitted the charge-sheet in said Halem P.S. Case No. 38/2024 vide Charge-Sheet No. 39/2024 dated 30.06.2024.

¶4In view of the above, the petitioner is directed to approach the appropriate forum/authority for his regular bail in said Halem P.S. Case No. 38/2024 corresponding to G.R. No. 115/2024 on or before 16.12.2024.

¶5The interim bail granted to the petitioner earlier on 26.06.2024 in said Halem P.S. Case No. 38/2024 is extended only upto 16.12.2024.

¶6With the above observation and direction, this pre-arrest bail application stands disposed of.
