¶1Heard Mr. N.N.B. Choudhury, learned counsel for the petitioner and Mr. P. Borthakur, learned Additional Public Prosecutor, Assam for the sole respondent/opposite party. Page No.# 2/2

¶2Mr. Choudhury, learned counsel for the petitioner submits that the petitioner had expired way back on 31.12.2017 and accordingly, his daughter, namely, Jitumoni Dey Baidya has furnished a copy of the notarized death certificate of the deceased petitioner.

¶3Mr. P. Borthakur, learned Additional Public Prosecutor, Assam has not raised any doubt with regard to production of the Death certificate of the deceased petitioner.

¶4This Court has perused the Death Certificate issued by the Registrar (Birth & Death), Municipal Board, Jorhat with seal and signature and accordingly, the said Death Certificate is accepted.

¶5In view of the aforesaid, the matter stands closed being abated on the death of the petitioner.

¶6Copies of the communication of the daughter of the deceased petitioner as well as the notarized Death Certificate of the petitioner be kept as part of record.
