Purna Mani Rai v. The State of Assam

ORDER Date : 27-11-2024 Heard Mr. P.K. Roychudhury, learned counsel for the petitioner Purna Mani Rai, who has filed this application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for bail as he is behind bars since

19.10.2024 in connection with Garchuk Police Station Case No. 328/2024 under Page No.# 2/3 Sections 61(2)/318(4)/179/180/3(5) of Bharatiya Nyaya Sanhita, 2023.

¶2Heard Ms. N. Das, learned Additional Public Prosecutor, Assam for the respondent State.

¶3The FIR unfolds on 19.10.2024 at about 10.30 AM acting on a tip off relating to transactions of fake Indian currency and fake gold, a team conducted search operation at ISBT parking area and recovered Rs.1,50,000/- (Rupees One Lac and Fifty Thousand) of fake Indian currency notes.

¶4The other accused have already been granted bail by the learned Additional Sessions Judge No. 5, Kamrup (M), Guwahati.

¶5As investigation has progressed substantially, I deem it appropriate to grant bail to the present petitioner as the petitioner is willing to cooperate with the remaining part of investigation.

¶6Considering all aspects, petition is allowed.

¶7Petitioner is enlarged on bail on furnishing a bail bond of Rs.50,000/- (Rupees Fifty Thousand) with a suitable surety of like amount to the satisfaction of the learned jurisdictional Court/Eleka Magistrate under the conditions that :

(i) the petitioner shall refrain from such activities with which he is alleged and,

(ii) the petitioner shall appear before the Investigating Officer on every fortnight till completion of investigation.

¶8On breach of any of the bail conditions, the Eleka Magistrate/jurisdictional Court is at liberty to cancel the bail granted to the petitioner. Page No.# 3/3

¶9In terms of the above observation, this bail application stands disposed of.
