Riju Nangflang v. The State of Assam

Heard Mr. S. Bipusha, learned counsel for the petitioner, Riju Nangflang, who have filed this application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for pre-arrest bail as he is apprehending arrest in connection with Garchuk Police Station Case No. 282/2024 (G.R. Case No. Page No.# 2/2 5277/24) under Section 87 of Bharatiya Nyaya Sanhita, 2023.

¶2Heard Mr. D. Das, learned Additional Public Prosecutor, Assam for the respondent State.

¶3It is submitted by Mr. D. Das, learned Addl. P.P., Assam that charge-sheet has been submitted in the case vide C.S. No. 177/24, dated 30.09.2024 in connection with Garchuk Police Station Case No. 282/2024 registered under Section 87 of Bharatiya Nyaya Sanhita, 2023.

¶4In view of the above, the anticipatory bail application stands disposed of with a direction to the petitioner to appear before the Jurisdictional Court within 15 (fifteen) days and seek bail, if so advised. If such bail application is filed, the same may be considered in accordance with law.

¶5The interim order dated 19.09.2024 will continue till the aforesaid period of 15 (fifteen) days.

¶6The letter relating to submission of charge-sheet forwarded by the S.I., Gorchuk P.S is marked as 'X' and kept as a part of the case record.

¶7Accordingly, this anticipatory bail application is disposed of.
