¶1Heard learned counsel Mr. P. Hazarika for the petitioner Hasinur Islam Shek @ Rambo.

¶2The petitioner has filed this application under Section 482 of the BNSS, 2023 Page No.# 2/3 with prayer for pre-arrest bail as he is apprehending arrest in connection with Jonai P. S. Case No. 95/2024 under Section 87 of the BNS.

¶3Heard Mr. R. R. Kaushik, learned Additional Public Prosecutor, Assam for the respondent State.

¶4The FIR unfolds that the informant's daughter went missing. The petitioner is apprehending arrest in connection with this case. The petitioner was granted interim bail and he has appeared before the Investigating Officer and he has also co-operated with the investigation.

¶5It is submitted that the petitioner is innocent and he is not involved in this case.

¶6I have considered the submission that the petitioner is willing to co-operate with the remaining part of investigation and to abide by any stringent bail conditions, if imposed upon him.

¶7Considering all aspects, the interim order dated 04.10.2024, is hereby made absolute under the conditions that;

(i) The petitioner shall appear before the Investigating Officer within 1 (One) week and co-operate with the investigation,

(ii) The petitioner shall not exercise threats to any of the witnesses, and

(iii) The petitioner shall not leave the jurisdiction Page No.# 3/3 of the Court without prior permission. On breach of any of the bail conditions, bail order shall automatically stand cancelled.
