K R Nagappan v. The State of Assam

ORDER Date : 23-10-2024 Heard learned Senior Counsel Mr. B.D. Konwar for the applicant Sri K.R. Nagappan, who has filed this interlocutory application with prayer for modification/alteration of the order 26.07.2024 passed by this Court in connection with Anticipatory Bail Application No. 1641/2024. Heard Mr. K. Baishya, learned Additional Public Prosecutor, Assam for the respondent State.

¶2It is submitted on behalf of the applicant that vide order dated 26.06.2024 in AB No. 1641/2024, the applicant was granted interim bail and subsequently, on 26.07.2024, the applicant's interim prayer was made absolute in connection with AB No. 1641/2024.

¶3The complainant had preferred a petition for cancellation of bail which was Page No.# 3/3 however rejected by the Hon'ble Supreme Court vide order dated 20.08.2024 in SLP (Criminal) Diary No. 35111/2024.

¶4It is submitted that the applicant was unwell and he was unable to appear before the Investigating Officer on 11.08.2024 and 26.08.2024 in compliance of the direction of this Court to appear every fortnight before the Investigating Officer. The applicant has prayed for extension of time.

¶5I have considered the submissions at the bar. The petitioner is directed to appear before the Investigating Officer within one week from today and comply with the terms and conditions imposed upon the applicant vide order dated

26.07.2024 in AB No. 1641/2024.

¶6In terms of the above observation, this application stands disposed of.
