ORDER Date : 03-10-2024 Heard learned counsel Mr. A.A.R. Karim for the petitioner Sri Ahammad Ali Khan, who has filed this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for pre-arrest bail as he is apprehending arrest in connection with Gauripur Police Station Case No. 170/2024 under Page No.# 2/2 Sections 120(B)/420/406 of the Indian Penal Code, 1860 corresponding to GR No. 728/2024.

¶2Heard Mr. R.R. Kaushik, learned Additional Public Prosecutor, Assam for the respondent State. Learned Additional Public Prosecutor has submitted that there are incriminating materials in the Case Diary against the petitioner.

¶3I have considered the submissions at the bar. I have also scrutinized the Case Diary.

¶4The allegation against the petitioner is that he is involved in dealing with fake gold.

¶5At this juncture, there appears to be no justified ground to grant the privilege of anticipatory bail to the petitioner as there are incriminating materials in the Case Diary against the petitioner. Hence, petition stands rejected at this stage.

¶6Send back the Case Diary.

¶7In terms of the above observation, this Anticipatory Bail application stands disposed of.
