Judgment
Court No. - 7 Case :- CIVIL MISC REVIEW APPLICATION No. - 125 of 2024 Applicant :- Mithilesh Singh Opposite Party :- State Of U.P. Thru. Secy. Food And Civil Supplies Govt. Lko And 4 Others Counsel for Applicant :- Amrendra Nath Tripathi,Sanjay Kumar Pandey Hon'ble Pankaj Bhatia,J. Heard learned counsel for the review applicant. The instant review application has been filed seeking review of judgement dated 20.11.2024 passed in Writ C No. 10096 of 2023. While passing the aforesaid judgement this Court was of the view that in terms of clause 10 of the government order dated
05.08.2019, the liability as prescribed in clause 10 did not occur in the case of then petitioner and based upon which the order had been passed which is contrary to the plain reading of clause 10 of the government order dated 05.08.2019. The contention of learned counsel for the applicant is that earlier a Public Interest Litigation (PIL) No. 754 of 2023 was filed making complaint against the allottee of fair price shop in which an order dated 22.8.2023 came to be passed in which statement was made by learned Standing Counsel that the shop license of the respondent no. 4 in the PIL No. 754 of 2023 was cancelled. On the basis of the said statement, the PIL was disposed of. The submission of learned counsel for the applicant is that there was a bungling and directions were there in paragraph 5 of the judgement dated 22.08.2023 to take action on account of the said illegalities, however the said authorities in passed the cancellation order on the ground that one of the family member has been elected as gram pradhan. The fact remains that the judgement sought to be reviewed had been passed solely based upon the interpretation of the government order dated 05.08.2019, I do not find any reason to interfere with the aforesaid order. The review application is dismissed. Order Date :- 20.12.2024 J. K. Dinkar High Court of Judicature at Allahabad, Lucknow Bench
