On 17.12.2024, this Court had passed the following order:- "Sri Ramesh Babu, learned counsel for the petitioner is reported to be ill today. In view of above, the case is adjourned today. List/put up this case on 20.12.2024. Taking note of nature of dispute involved in this case, it would be apt to observe here that the case would not be adjourned on the next date of listing on any ground and appropriate orders would be passed in first call even in absence of petitioners' counsel." Today, when the case was taken up, it has been informed that Sri Ramesh Babu, learned counsel for the petitioner is out of station today Taking note of previous order of the Court, this Court declines to entertain the out of station of petitioner's counsel. In view of aforesaid and also taking note of the maxims (i) Vigilantibus non dormientibus jura subveniunt (The law assists only those who are vigilant, and not those who sleep over their rights); and (ii) Interest reipublicae ut sit finis litium (In the interest of the society as a whole, the litigation must come to an end), the instant petition is dismissed for want of prosecution.
