Court No. - 16 Case :- CRIMINAL APPEAL No. - 1695 of 2024 Appellant :- Jaichand Kumar Maurya @ Putan Respondent :- State Of U.P. Thru. Prin. Secy. Home Lko. And Another Counsel for Appellant :- Bhanu Pratap Kushwaha,Mohammad Salman Counsel for Respondent :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the appellant, learned A.G.A. appearing for the State and perused the record. This criminal appeal has been filed by the appellant under Section 14A (2) the Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 to set aside the order dated
26.04.2024 passed in Bail application No.437/2024, arising out of case crime No.342/2023, under Section 406 I.P.C. and Section 3(1)(r), 3(1)(S) of S.C./S.T. Act, Police Station Mishrikh, District Sitapur. Learned counsel for the appellant while pressing the appeal submits that, the appellant has been falsely implicated in this case. Nothing as claimed by the prosecution has been committed by the appellant. It is contended on behalf of the appellant that appellant has been falsely implicated in this case. The entire Rs.60,000/-has been returned to the victim still he has been falsely implicated. Appellant has no criminal history. No useful purpose will be served to keep the appellant in custody. The appellant undertakes to cooperate in the trial. It is further submitted that, the appellant is languishing in jail in this matter since 02.04.2024. Charge-sheet in the matter has already been submitted. There is no likelihood that the appellant-applicant after release on bail may flee from the process of law or will misuse the liberty of bail granted by this Court. Learned A.G.A. opposes the prayer for bail, but could not confront the factual submissions made by the learned counsel for the appellant-applicant. Considering the facts and circumstance of the case, period of incarceration gone into by the applicant prima facie from perusal of the F.I.R. as well as the statement of the complainant under Section 161 Cr.P.C. the ingredients to attract the offence under Sections 3(i)(r) &3(i)(s) of the SC/ST Act appears to be missing, applicant has no criminal history and without commenting upon merits, I am of the view that the learned court below has failed to appreciate the material available on record. In view of above, the order passed by the court below is liable to be set aside. Accordingly, the appeal is allowed and the order dated 26.04.2024 passed in Bail application No.437/2024, arising out of case crime No.342/2023, under Section 406 I.P.C. and Section 3(1)(r), 3(1)(S) of S.C./S.T.
