Judgment
Court No. - 16 Case :- CRIMINAL MISC. WRIT PETITION No. - 1003164 of 2015 Petitioner :- Smt. Rajkumari Respondent :- State of U.P. and Another Counsel for Petitioner :- Ravindra Nath Pandey Counsel for Respondent :- Govt. Advocate Hon'ble Shamim Ahmed,J. List has been revised. None appeared on behalf of the petitioner even in revised call of the list to press this petition. Sri Ashok Kumar Singh, learned A.G.A.-I for the State is present. The instant writ petition was filed seeking following main relief:- "(i) issue a writ, order or direction in the nature of certiorari quashing the impugned orders dated 16.04.2015 and 18.01.2014 as contained in Annexure No.1 and 2 to the writ petition, respectively in the interest of justice." I have gone through the impugned order dated 18.01.2014 by which the application under Section 245(2) Cr.P.C. was dismissed by the learned trial court after considering the entire evidence on record. The order was passed in detail and the petitioner failed to justify his case before the learned trial court. Aggrieved by the aforesaid order dated 18.01.2014, the petitioner preferred a Criminal Revision before the learned Additional Sessions Judge / F.T.C. No.1, Raebareli, which was also dismissed vide order dated 16.04.2015 by a detailed order. I have perused both the impugned orders and do not find any illegality or infirmity in the impugned orders. Both the orders are reasoned and speaking and have been passed after considering the entire evidence on record. Thus, this Court is not inclined to interfere in the impugned orders and even though the petition is of the year 2015 and the petitioner has also lost his interest in pursuing the matter. As such, the petition lacks merit and is hereby dismissed. File consign to record. Order Date :- 29.8.2024 Saurabh High Court of Judicature at Allahabad, Lucknow Bench
