At the outset, learned Counsel for the petitioners submits that he does not want to press this petition on merits and wants to withdraw the same and file a fresh petition/application before the Division Bench of this Court in view of the Full Bench decision of this Court in Ram Lal Yadava vs. State of U.P.;

(1989) 1 MWN (Cr.) 198 All (FB), thus, he submits that the present petition may be dismissed as withdrawn with liberty as prayed. Learned A.G.A. for the State-respondent has no objection to the prayer made by learned Counsel for the petitioners. In view thereof, the present petition is hereby dismissed as withdrawn with liberty as prayed by learned Counsel for the petitioners. Office is directed to return all the certified copies annexed with this petition to learned Counsel for the petitioners, after keeping a photostat copy of the same on record.
