Court No. - 16 Case :- MATTERS UNDER ARTICLE 227 No. - 4063 of 2024 Petitioner :- Pankaj Rajput Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home U.P. Lko. And 2 Others Counsel for Petitioner :- Saksham Agarwal,Rakesh Kumar Agarwal Counsel for Respondent :- G.A. Hon'ble Shamim Ahmed,J. Heard Shri Saksham Agarwal, the learned counsel for the petitioner as well as the learned A.G.A. for the State and perused the record. This petition under Article 227 of the Constitution of India has been filed seeking direction to the learned Additional Principal Judge-7, Family Court, Lucknow, to decide the application filed by petitioner under Section-340(1) Cr.P.C 1973 read with Section-195 Cr.P.C. in case bearing no. 1482 of 2022, Aditi Singh versus Pankaj Rajput, pending before it, as expeditiously as possible, preferably within a period of 1 month. Learned counsel for the petitioner submits that a positive direction be given to the trial court to decide the aforesaid application within a stipulated period. The learned A.G.A. has no objection on the prayer made by the learned counsel for the petitioner and submits that a positive direction be given to the trial court to decide the said pending application of the petitioner, as merely keeping pending the same by the trial court does not suffice any purpose of the litigation. In view of the statements made by the learned counsel for the parties, the trial court is directed to decide the pending application moved by the petitioner in above mentioned case expeditiously, without granting any unnecessary adjournment to either of the parties from the date of filing of the certified copy of this order, unless there is some legal impediment or unless there is any order passed by the higher court staying the proceedings of the case. With the aforesaid observation, the petition is disposed of finally. (Shamim Ahmed, J.) Order Date :- 28.8.2024 A.Nigam High Court of Judicature at Allahabad, Lucknow Bench
