¶1Heard Mr. Afzal Hasan, learned counsel for the petitioner and learned Standing Counsel for the respondent nos.1 to 4.

¶2By means of present petition, the petitioner has sought to restrain the private respondents from constructing a Shiv Mandir which according to the petitioner is recorded as Harijan Abadi.

¶3When query is made to the petitioner as to whether he is aggrieved by the said action of the private respondents, he fairly submits that he is not aggrieved person and consequently, at this stage, prays that he may be permitted to withdraw this petition with liberty to file Public Interest Litigation with regard to the said issue.

¶4Learned counsel for the respondents did not object the prayer made by the petitioner.
