¶1Vakalatnama filed by Shri Qasim Abbas Zaidi, Advocate on behalf of opposite party nos.2 and 3 is taken on record.

¶2Learned counsel for the applicant, learned counsel for opposite party nos.2 and 3 as well as learned A.G.A. for the State and perused the record.

¶3The present application u/s 482 Cr.P.C. has been moved with prayer to quash the impugned charge sheet dated 27.09.2008 arising out of Case Crime No.665 of 2008, under Sections 294, 354, 384, 452, 504, 506 I.P.C., Police Station Thakurganj, District Lucknow as well as the entire proceedings of Case No.3569/2008; State Vs. Shahid @ Chand pending before the Special Additional Chief Judicial Magistrate, CBI (A.P.), Lucknow.

¶4It is submitted by learned counsel for the applicant that there was some dispute between both the parties and the matter was investigated by the Police, thereafter, the charge sheet was submitted and cognizance was taken by the learned trial court and proceedings were initiated. In the meantime, both the parties entered into a compromise and filed application under Section 482 Cr.P.C. No.3420/2023 before this Court which was decided vide order dated 11.04.2023 with the direction to the parties to verify the aforesaid compromise deed before the learned trial court. In pursuance thereof, the parties appeared before the learned trial court and compromise was got verified by order dated 29.04.2024 and certified copy thereof has been filed by the applicant in this application which is on record. In view of the aforesaid compromise, it will serve no purpose to keep the proceedings pending in the Case Crime No.665 of 2008, under Sections 294, 354, 384, 452, 504, 506 I.P.C., Police Station Thakurganj, District Lucknow.

¶4Learned A.G.A. as well as learned counsel for the opposite party nos.2 and 3 have no objection to the aforesaid prayer of the applicant.

¶5In view of the above, the entire proceedings of Case No.3569/2008; State Vs. Shahid @ Chand pending before the Special Additional Chief Judicial Magistrate, CBI (A.P.), Lucknow as well as charge sheet dated 27.09.2008 arising out of Case Crime No.665 of 2008, under Sections 294, 354, 384, 452, 504, 506 I.P.C., Police Station Thakurganj, District Lucknow are, hereby, quashed in terms of the compromise.
