¶1Heard learned counsel for petitioner and learned State Counsel for opposite parties.

¶2Petition has been filed seeking a direction to opposite parties for payment of minimum of the pay scale to petitioner as is being provided to similarly situated daily wage employee.

¶3It has been submitted that petitioner as was engaged in service as daily wage employee in the year 2008 and is continuously working as such but has been deprived at the aforesaid benefit.

¶4For the said grievance, petitioner has already submitted a representation but seeks liberty liberty to file a fresh representation before the authority concerned. At present, learned counsel for petitioner restricts his prayer for a final decision with regard to same.

¶5Considering the innocuous prayer, without entering into merits, liberty is granted to petitioner to file a fresh representation before opposite party no. 2 i.e. Director, Horticulture & Food Processing, 2-Sapru Marg, Lucknow who shall consider and decide the same within a period of eight weeks from the date a certified copy of this order is produced before the said authority along with fresh representation.
