Heard learned counsel for the petitioners and learned AGA for the State. The petition has been filed with the following main prayer:- Issue a writ, order or direction in the nature of Certiorari for quashing the impugned first information report dated 31.08.2023 at about 13.48 hrs. lodged by the opp. party no.4 against the Petitioners and two other named persons as first information report No. 0581/2023, under section 419, 420, 406 1.P.C. at Police Station Kotwali City, District-Pratapgarh, contained as Annexure No.1 to this writ petition, in the interest of justice. It has been submitted by learned counsel for the petitioners that they have been falsely implicated in the present case. Learned AGA has produced before this Court instructions sent by Sub Inspector Rajesh Kumar Rai, P.S. Kotwali Nagar, District Prataprh, wherein it has been stated that charge sheet dated 10.09.2023 has been prepared and submitted to the Circle Officer. It has been further submitted that name of petitioner no. 2 Vijay Maurya has been deleted during the course of investigation. Instructions provided by the learned AGA are kept on record. Since the investigation has been concluded and charge sheet has been prepared against on of the petitioners, the writ petition is dismissed. Order Date :- 22.12.2023 R.C.
