Commissioner Judical Second Lko And 3 Others Counsel for Petitioner :- Mohd Kamal Khan Counsel for Respondent :- C.S.C.,Dilip Kumar Pandey Hon'ble Shree Prakash Singh,J. Heard learned counsel for the petitioner, Sri Hemant Pandey, learned Standing Counsel for the State, Sri Dilip Kumar Pandey, learned counsel for the Gaon Sabha. At the very outset, learned Standing Counsel appearing for the State has pointed out that the petitioner is said to have filed a revision against the order passed under section 67(5) of the U.P. Revenue Code, 2006, thus, the revision is not at all maintainable as there is no such statutory provision, whereas this writ petition has been filed seeking direction to the respondent no. 1, though the revision itself is not maintainable, then the direction sought is of no avail. On the other hand, learned counsel appearing for the petitioner could not rebut the aforesaid facts. In view of aforesaid, the instant writ petition is dismissed with liberty to assail the order passed under section 67(5) of Code, 2006. OfÏce is directed to return the certified copies of the orders, if any, to the learned counsel for the petitioner, after procuring the photocopies of the same on record.
