¶1Heard learned counsel for the petitioner and learned Standing Counsel for the State. Ms Aishwarya Jaiswal, learned counsel has filed Vakalatnama on behalf of opposite party no. 5.

¶2This writ petition filed in public interest has sought a relief to the effect that the illegal encroachment over the public utility land declared as surplus i.e. Gata No. 235-Sa area 0.051 hectare, Gata No. 236 area 0.051 hectare and Gata No. 240 area

0.240 hectare, total area 0.275 hectare, situated in Baraura Husainbadi, Balaganj, Lucknow may be removed.

¶3From a perusal of Annexure-1 to the writ petition itself it is evident that the petitioner herself has an interest in the aforesaid Gatas and it is stated that she is already pursuing the legal recourse for identification and release of the land in question in her favour. That apart, the credentials of the petitioner to maintain the present writ petition in public interest are not satisfactorily stated to conform to the requirement prescribed under the rules of the Court.

¶4That being so, the present writ petition in public interest, firstly for involvement of petitioner's own cause and secondly, for the credentials of the petitioner remaining undefined, is not maintainable.
