Counsel for Respondent :- Basu Deo Mishra Hon'ble Attau Rahman Masoodi,J. Hon'ble Manjive Shukla,J. This state appeal filed under Section 378 Cr.P.C. was admitted by order dated 10.09.1991. Living status report of respondent nos.1 and 2 Ayodhya and Meva Lal was called for through the Chief Judicial Magistrate,Lucknow. As per the report forwarded to this Court by Chief Judicial Magistrate, Lucknow, both the respondents namely Ayodhya and Meva Lal have died during pendency of the present appeal. The verification of both the respondents namely Ayodhya and Meva Lal is duly made on the basis of the statements of the local residents as well as the death certificate issued by the Gram Pradhan. In view of the report forwarded to this Court by Chief Judicial Magistrate, Lucknow dated 17.04.2023, the appeal instituted by the State as a consequence of death certificate of respondent nos. 1 and 2 namely Ayodhya and Meva Lal has abated and the same is accordingly dismissed as abated.
